Head of state immunity is a principle of international law that protects sitting heads of state from being prosecuted or sued in foreign courts. This immunity is rooted in the idea of sovereign equality, which holds that one state cannot judge or interfere in the internal affairs of another. There are two types of immunity for heads of state:1.Immunity ratione personae (personal immunity): This applies to heads of state during their time in office. It provides complete immunity from criminal or civil jurisdiction in foreign courts, including for acts unrelated to their official duties. Once they leave office, this type of immunity no longer applies.2.Immunity ratione materiae (functional immunity): This applies to actions taken in an official capacity while in office, even after the individual leaves the position. However, this immunity doesn’t apply to international crimes like genocide, war crimes, or crimes against humanity.These forms of immunity aim to preserve diplomatic relations and respect state sovereignty while balancing accountability for serious crimes.
